1. The Scheme Meeting and Effective Date

On November 14, 2008 by order of the Supreme Court of Bermuda, a meeting of Scheme Creditors (the “Creditors’ Meeting”) was convened for February 19, 2009 in Bermuda. At the Creditors’ Meeting the Scheme was approved by the requisite voting majorities of Scheme Creditors. A copy of the Chairman’s report of the Creditors’ Meeting is available below.

Following the Creditors’ Meeting, at the Scheme Sanction Hearing on March 19, 2009, the Supreme Court of Bermuda ordered that the Scheme be sanctioned and upon delivery of the Order to the Registrar of Companies on March 20, 2009, the Scheme became effective. The Scheme is now binding on all Scheme Creditors.

2. Impact of the Scheme – Claim Form

You marked your Scheme Voting Form as your Claim Form and therefore, in accordance with section 3.3.2 of the Scheme, your Scheme Voting Form has been accepted by the Company as your Claim Form. As such, you are not required to submit a Claim Form by the Claims Submission Date. However, should you wish to modify your Scheme Claim you have the ability to submit an amended Claim Form at anytime up to the Claims Submission Date.

Please return all Claims Submission by 5pm (Bermuda time) on June 19, 2009.
